Our Clients often ask "How long will a worker's compensation case take?" Unfortunately, we cannot give an exact answer. The reason for the uncertainty is that no two injuries are the same, and no two people are the same. The length of the case greatly depends on how quickly our Client is able to heal. The typical workers' compensation timeline is as follows (It is important to keep in mind that every case is different, and this timeline isn't set in stone):
1. Work related injury occurs. (Our Client contacts us immediately).
2. Injury is reported to the employer.
3. Client has initial Doctor's visit.
4. The Doctor makes a diagnosis, and prescribes a treatment.
5. The Workers' Compensation case is filed with the Illinois Workers' Compensation Commission.
6. The case is typically assigned to an arbitrator and given a 3 month status date.
7. The case is automatically scheduled for status every 3 months for up to 3 years.
8. Negotiations are always occurring.
9. The case may be settled, dismissed or set for trial at any time.
